legs and walked across his bedroom before opening fire. but the defense is presenting a very different account of what happened. michelle kosinkski sat near pistol f pistorius in court. what drove adam lanza to launch his killing street at a newtown elementary school? we have new information and new video of lanza as a young boy, recently discovered. ever been busted by one of the red light cameras? they raise a lot of money in fines and reduce accidents, but are they catching too many innocent drivers? we will get into that story. the bail hearing for oscar pistorius in south africa. michelle kosinkski was in the courtroom. now to up. >> reporter: the level of emotion we saw from pistorius, hard to put into words. you hear his sides of things from prosecutors, absolutely

gripping, but it makes things no less perplexing. did pistorius accidentally kill the woman he loved and was thinking of marrying or was this premeditated murder? he broke down, sobbing with his head in his hands. oscar pistorius faced the court with the global scrum of he's accustomed to. prosecutors didn't allow pictures during the hearing. he was stern faced. staring ahead, jaw clenched. little of the powerful emotion he could barely control during the first appearance. then the emotion came, crying, head in hands as prosecutors laid out their case accusing pistorius of shooting and killing an unarmed innocent woman, his girlfriend, reeva steenkamp on valentine's day morning. he was inconsolable when he heard his account read by his attorney. he woke up in the night to get a

fan from the balcony and heard a noise. he heard someone in the bathroom. he felt a sense of terror rush over me. i knew i had to protect reeva and myself. i received death threats before. i grabbed my .9 millimeter pistol from your honor tunder t screamed for them to get out of my house. it was pitch dark in the bedroom and i thought reeva was in bed. after the shooting when he realized she was not, he broke through the door after he called a friend and paramedics. she died in my arms. prosecutors ask why would a burglar lock himself in the toilet? reeva locked that door for a purpose. even if he thought it was a burglar this would still be a premeditated murder of a defenseless burglar. attorneys say there was no motive, no premeditation. statement from friends, even steenkamp's best friend describe the couple as deeply in love.

same time as all of this, her funeral. >> we are devastated as a family. only one thing missing, reeva. >> reporter: prosecutors did make reference to the possibility there was an argument between the couple that night, but they didn't get into it in this hearing. tomorrow, we expect a judge to decide whether or not pistorius will be let loose. i'm sorry will be released on bail. david. >> michelle kosinkski, thank you very much. graham hoskins, a crime security analyst was in the courtroom as well. graham, good morning to you. >> good morning. how are you doing? >> i'm doing well. tell me more about the theory of the case on the part of pistorius that we learned about for the first time in this bail hearing? >> look, from this morning from his version of events that he woke up, went out to get a fan on the balcony, heard a noise

from the bathroom, alongside the balcony and he then became worried, screamed to reeva to call police and demanded that the person come out. when there was no response, he then grabbed his firearm, you have to remember at this stage, he didn't have his prosthetic limbs on at all ran to the bathroom, screamed to reeva to call police and opened fire. when he called reeva again, he realized that there was something obviously horribly wrong. ran back to the bed. when he didn't see her, he says now in hindsight he realized she had obviously gone to the bathroom when he went out on the balcony to collect the fan. he claims to have run back out to the balcony, called for help, come back, put his prosthetic limbs on and tried to bash open the door. >> one of the questions that prosecutors were alluding to, was there any kind of difficulty in their relationship? if she had locked herself in the

bathroom for a reason. any inkling of what that evidence is likely to show about the nature of their relationship that may have led to this? >> the evidence they are likely to present tomorrow is along social media messages that were sent between her and other male friends that she had. family said she's very loving, loves all people regardless of what their relationships are, and alleging that she became involved in an argument with him, possibly over jealousy over messages sent between herself and her other friends. so they are alleging that's what the argument was over. >> help, graham, educate us in the difference between legal procedure between south africa and the united states. so much emotion around this trial, around this case, this is a beloved figure, but he's not appealing to a jury here this would not be a jury trial. >> no, this won't be a jury trial in south africa we don't have juries.

when a case initially comes before a court and goes before a magistrate, from a magistrate, it then goes to a high court and a high court depending on the severity of the case and crime, it will be before a judge who will have either one or two assistants to help decide the legitimacy of the allegations and whether or not there is guilt and in the states, where you have a jury, we do not have a jury. >> one of the big questions, of course, you know, in a high-profile case like this, and pistorius talked about it. he is not a flight risk, should be granted bail. given your experience, what is the likelihood of that happening? >> look, it's 50/50. they got the magistrate to rule u.s. a schedule 6 offense, schedule six offense in south africa are the maximum and if convicted, on a schedule 6 offense such as murder, you have to prove it's premeditated

murder, and those carry life sentences, so if he is convicted off a schedule 6 offense, the earliest he'll be he eligible for parole is 25 years' time. his defense team argued it was actually a schedule 5 offense, a lesser offense, not premeditated and almost an accidental killing. but they were unfortunately unsuccessful. so he's now facing the very severe possibility of being locked up for life. >> graham hoskins, thank you so much. appreciate it. >> absolutely a pleasure. >> his state of mind, too, as you know, is something that people will comment about. his weeping in court and then whatnot. it's going to be a factor, each if it's not a jury trial. >> i was going to say, the big difference, it's a judge hearing the evidence in the case. jurors tend to be more persuaded by things like celebrity, emotion inside a courtroom. this will be extremely fractured. cases like a locked door.

friends back home. the reality of our lives, if we live long enough we're going to fail at something. i absolutely failed in my personal life and my marriage. but one place i didn't ever fail was with the taxpayers. if you look at my 20 years in politics, what you would see is a fairly remarkable consistency in terms of looking out for the taxpayer. the ill that's before us as a civilization, if we don't get our financial house in order, there will be incredible consequences for the dollar, american way of life, all that and more. >> couple of things about that, though. number one, you paid a fine. ethics charges related to misusing taxpayer funds. you don't have to get into the nitty gritty about it. >> sure. >> but doesn't that go against your argument of being fair to the tax payers? >> no. if we were to get into the nitty gritty, you would find there was no admission of guilt with any of that. in the same way that a lawyer would settle a case -- you are a lawyer by training. this happened, but by no means

did we agree this happened. and the house, by no means fans, absolved us of all of that. it is a much longer story. >> to the larger issue, do you really need to run for public office? what is this about? you care about debt and deficit. these are issues well discussed in washington. >> that's just the problem. they are well discussed but all too often too few choose to take real action. and i was actually rated number one in the united states congress by the taxpayer union, citizens against government waste, rated the most fiscally conservative governor in the united states. it points to one thing. many people talk about our spending problem in washington, all too few are trying to do something about it. >> you've been around for a long time. for you, the price of re-entering politics is drudging up all the things we just saw. it may be embarrassing to you but to the people around you,

including your ex-wife, your family. is it worth it? >> no. there's definitely pain in the clips you were just showing. but i sat down with the boys. we had a conversation. i said what do you want me to do? if you don't want me to do it, i'm out. their point is no, dad, you've long cared about this stuff. you ought to do it. i also would say i've been on something of a personal journey. i believe if you live long enough, you will fail at something. i failed mightily. there is a saying, the higher you rise, the bigger you fall. i failed. in some ways i've come to learn that ultimately our brokenness as human beings is ultimately our connection. and that goes to a larger article of faith and a lot more. >> and you have been very introspective these past few years. you've talked about that. have you asked yourself, what is this really about? is it about these issues of debt and spending or is this about seeking some kind of personal, political redemption? >> i think we all hope for redemption in our lives. that is one of the great journeys of our respective lives. but i would say my focus is crystal clear, which is, is part

of the cost of re-entering politics a discussion about my personal failure and the consequences thereof? yes. is that painful to me and a lot of others that i love? yes. but i keep going back to we are at a tipping point as a civilization. if we don't get our financial house in order, there will be unbelievable consequences to the folks watching this show right now. >> mark sanford, it's great to have you here. thank you for being here. appreciate it. now here's david. switching gears this morning, the duchess of cambridge is making just her second formal appearance. we're at buckingham palace this morning. >> reporter: good morning. in fact, this is the first time we've seen the duchess of cambridge in public since christmas, officially at least. she is now very visibly pregnant. she appeared wearing a figure-hugging dress and holding her hands protectively in front of her. a blossoming duchess of

to have a whole new look. we'll start this hour with the controversial cameras used to catch you running red lights. many people argue they're often inaccurate or unfair. tom costello has been looking into that story. tom, good morning to you. >> reporter: savannah, good morning. 24 states and d.c. allow these red light cameras. nine states ban them. fairness is the big issue. in court, depending where you are, you might be able to ask a police officer about the ticket he wrote you, but you can't do that with a camera and the camera presumes that you're guilty, not innocent. they can be horrific crashes, red light runners are especially dangerous because the people they hit are usually caught completely by surprise. each year, some 700 people die and 122,000 are injured in accidents involving a driver who ran the red. to cut into that rate, more than 540 communities nationwide have

turned to red light cameras. in washington, d.c., the police chief is a firm believer. >> even just in the last five years, 54 traffic fatalities down to 19. that's dramatic. >> reporter: nationwide, insurance institute for highway safety says cameras have cut crashes by 24% and fatalities at intersections by 17%. >> when traffic violations are enforced, violations go down. >> reporter: so why then is this lawmaker in new jersey determined to tear them all out? >> because they're a rip off. because they are designed to steal money from innocent people. >> reporter: assemblyman declan o'scanlan says it's become big money makers, people who stopped just over the white line, who didn't quite clear the intersection before the red, who turned right on a red, who are waved through by a construction crew or who were forced into the intersection by a passing emergency vehicle. >> 80, 90% of the people who get

tickets are behaving reasonably. the systems are designed to punish innocent people. >> reporter: and red light tickets can be expensive. $50 in new york, $75 in colorado, up to $200 in illinois. plus points. in dallas, nbc 5 found the cash adds up. >> reporter: some cameras bring in money the size of an nfl paycheck. there's one camera in arlington, texas, that's generated $2.5 million of tickets in four years. >> reporter: in the greater washington, d.c. area, nbc 4 tallied up the fines. >> we found drivers in the d.c. capital region received at least $18 million in fines in just a one-year period alone. >> reporter: then there's the yellow light issue. traffic engineers recommend three to six seconds of yellow before the light turns red but there is no national standard, sometimes no state standard. the less time on yellow, the more red light tickets. in new jersey, steve katzman got one but wasn't even in town that

day and he can prove it. someone else was driving his car. why should he have to pay for a moving violation someone else committed? >> i was frustrated and angry. it was an unfair burden that i thought was placed on me as the owner of the car. >> reporter: out of principle, he spent a small fortune, fighting the ticket and won. but in 24 states, big brother is watching the red. and another issue here. many of these states and cities actually have a private company running the red lights and that private company shares the revenue with the city. in some cases, these companies have actually lost their contracts because they were found to not be calibrating the lights properly and also because they were found to be, in some cases, paying off members of city council. so, there's a lot of controversy here across the country. s savannah? >> that ought to burn people up to hear that. tom costello, thank you very much. you support red light cameras, is that it? >> the speeding cameras are too pervasive perhaps. >> let's talk about the weather. >> let's do that. >> let's go outside and head for

investigating that articles were found in the lanza home details that massacre in norway. >> they are a long way from determining a motive, that this may have motivated him and any talk of this is pure speculation, but could he possibly have been trying to emulate this mass murderer or other murderers? >> yes. he destroyed his hard drive. they're trying to put it back together and they're trying to get information, did he have a secret life, secret identity? what was he angling toward? and then if you find articles about the worst mass murder in history in the guy's game room you're going to start to wonder. >> another piece of this has to do with adam lanza and video games. investigators are looking into the time he spent playing, presumably, violent video games. what did you find? >> we learned that there were

thousands of dollars worth of video games that they discovered in the home. we learned that he had been playing video games for a while. and josh actually talked to a tech adviser who discussed some of the games that he had played earlier on. >> and is the notion that perhaps he was trying to re-enact some of these scenes or that he had become desensitized to them? >> well, i think he did what he knew how to do. violent video games, graphically violent video games don't make you turn into violence if that's not your predisposition. but this kid had a lot going on. and when it came time for him to carry out this terrible rampage, he did it in a way he was accustomed to. >> let's talk about one of the most perplexing figures in this case, aside from adam lanza himself, which is nancy lanza. she's a polarizing figure. on one hand she's the 27th victim.

some of your reporting suggests this was a woman, single mom, overwhelmed trying to do the best by her son. others view her as a villain, gun-obsessed mother who allowed her son access to guns and fester in the basement playing video games while she traveled and enjoyed a night life. what did you make of nancy lanza? >> we wanted to learn more about nancy lanza. that's one of the objectives about this story. we heard so much about her being this pair annoyed doomsday prepper, stockpiling food, waiting for this economic collapse and we learned through our reporting that she had done a number of things to get adam in the right place. there were all these different educational shifts in and out of school. so we learn that she actually was trying to do the right thing by adam, whether or not it was that remains to be seen. >> josh, there has been a lot of talk that he may have had

asperg aspergers. you also write about another condition, sensory disorder. is it widely accepted in the medical community? >> not widely embraced in terms of a diagnosis, but it manifests itself in difficulty managing sight, sound, smells, noise, pain. >> you write that he did not like to be touched. >> right. that was a theme all through his life, as early as when he used to tag along at his brother's cub scout meetings. nancy lanza told the cub scout master, don't touch him. don't casually touch him. he doesn't like it. he recoils. >> in just a few seconds left, it's obvious how much reporting went into this and how ridiculously you looked into this situation. do you come away ultimately unsatisfied? i don't know that we get the answer why. >> you know, that's just it. are we ever really going to know the why? there may be two people that know that answer, nanci and adam, and they're not here to tell us. >> it's an excellent piece of

locked bathroom door. claiming a noise from the bathroom woke pistorius that night, causing him to grab his gun to protect himself and reeva. the affidavit says pistorius felt vulnerable without his prosthetics legs and strapped them on, fearing that intruders are climbed into the bathroom window. scientists are blaming global warming for recent wild winters. climate change is a reason for less overall snowfall in the midwest and northeast over the past couple of years. it's also the culprit for those increasingly common massive blizzards and researchers say less snow and more blizzards are on the way in the winters to come. drew peterson was back in court today, asking for a new trial. peterson says his lawyer botched his trial for the murder of his ex-wife, kathleen savio. if a retrial is not granted, the judge will move on to sentencing. peterson is facing 60 years in prison. jesse jackson jr. may be in court this week as well. the former congressman plans to plead guilty to using campaign

should we turn more serious and go to natalie for a check of the top stories? we have some serious news. premeditated murder is the charge against olympic runner oscar pistorius, who wept in a south african courtroom as prosecutors claim he shot his girlfriend, model reeva steenkamp, while she hid behind a locked bathroom do door. in an affidavit read by the athlete's lawyer pistorius said he was, quote, deeply in love with steenkamp and had no intention of killing her. he claims a noise from the bathroom woke him, causing him to put on his prosthetic legs to protect himself and reeva. sad new details of country singer mindy mccready's final days. her former boyfriend billy mcknight said she was allowed to leave rehab just after 17 hours. days later she took her life. she had threatened suicide after

everything so far has been heavy rainfall. right now, most of the rainfall is still on the north end of the bay area. by 11:00, it's going to centralize over the south bay qula. so keep that in mind. by 1:00 p.m., we'll start clearing out, then finish the day with cloudy conditions. thursday, temperatures are going to stay cool. another chance for rain and another one on saturday. a rough drive. >> it is a rough one. here, foster city, turn the camera, you can catch the bottom of the screen. 92 west over toward the right side of your screen, but look at the parking lot. it's very wet. soupy conditions. the map shows you on the peninsula side, 101 and 92. there's a crash west 92 heading over toward el camino causing more slowing. 880 still recovers after a crash by the coliseum. still slow south toward 580 and there's the bay bridge. >> we're going to have a look at

police have released a sketch of a man they say attacked and raped a young woman. a muscular white man in his 30s, dark hair and goatee. a tree nearly split in half at a home after a tree coming crashing down near danville. three of the four family members were home when it hit. the owners can't go inside to get any of their belongings. a tree expert has been called in to try to figure out why the massive tree fell. looks like it had some age to it as well. quite a call they're going to have to make to their insurance agent. i'm going to have another update in about half an hour. we'll also include a look at weather and traffic. have a great tuesday morning.
